The intellectual property rights in all software and content (including photographic images) made available to you on or through this Website remains the property of DIOANE or its licensors and are protected by copyright laws and treaties around the world. All such rights are reserved by DIOANE and its licensors. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise.

Terms of Sale

By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

Dispatch times may vary according to availability and subject to any delays resulting from postal delays or force majeure for which we will not be responsible. 

In order to contract with DIOANE you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. DIOANE retains the right to refuse any request made by you. If your order is accepted we will inform you by email and we will confirm the identity of the party which you have contracted with. This will usually be DIOANE or may in some cases be a third party. Where a contract is made with a third party DIOANE is not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.

(a) Our Contract 

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation by e-mail that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.

(b) Pricing and Availability

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.

(c) Payment 

Upon receiving your order we carry out a standard authorization check on your payment card to ensure there are sufficient funds to fulfil the transaction. Your card will be debited upon authorisation being received. The monies received upon the debiting of your card shall be treated as a deposit against the value of the goods you wish to purchase. Once the goods have been despatched and you have been sent a confirmation email the monies paid as a deposit shall be used as consideration for the value of goods you have purchased as listed in the confirmation email.

Disclaimer of Liability

The material displayed on this Website is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law DIOANE and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Website or the Linked Sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. This does not affect DIOANE's liability for death or personal injury arising from its negligence, fraudulent misrepresentation, misrepresentation as to a fundamental matter or any other liability which cannot be excluded or limited under applicable law.

Linking to this Website

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any website that is not owned by you.

DIOANE shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services and/or any page of this Website.

Invalidity

If any part of the Terms of Service is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms of Service will not be affected all other clauses remaining in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.

Complaints

We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise, please let us know if you have any complaints or comments.

Waiver

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

Entire Agreement

The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and DIOANE. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of DIOANE.

2. Returns and Refunds Policy

Returns and Refunds

DIOANE is confident that you will be delighted with your jewelry purchase. We value our customers and your satisfaction is of utmost importance to us. As such, we are glad to offer you a generous 7-day money back guarantee policy. If within 7 days after receipt of your purchase you're not completely satisfied with our products, you are welcome to make a return for a full refund of your jewelry. Kindly refer to the following guidelines: -

Check Jewelry Immediately Upon Delivery

Always check the jewelry thoroughly upon delivery, before signing the carrier’s delivery order. If the items were damaged during shipping, please make a claim with the carrier company. 

Returning Jewelry For A Full Refund

We strive to display pictures which truely represent our quality jewelry. If you are not satisfied with our products, please contact us within the 7-day period upon receiving the shipment. Please indicate your order number and your reasons for wanting a full refund for the jewelry.

Returning Defective Jewelry

It is extremely unlikely that you will receive defective jewelry from DIOANE. All DIOANE jewelry are handmade, so no two pieces are alike. Jewelry delivered may differ slightly from pictures shown on our website. Such minor variations are not considered defects.

Return Authorization

Each return request will be assessed on a case-to-case basis. Kindly note that the delivery charges for the return to us will be borne by you. For any refunds, your money will be refunded or your credit card account will be credited for any payments you have made towards the returned purchase. The delivery charges will not be refunded. Please allow one monthly billing cycle in order for your credit to appear.

Before returning any jewelry, be sure to obtain a return authorization note from us. The note will contain a return reference number which will facilitate our communication. This is essential if you wish to have a refund. All jewelry returned MUST be in original and unused condition with original packaging and shipping documents. Packages must be returned prepaid. We cannot accept Cash-On-Delivery deliveries. Returns should reach us within 7 days of our issuing a return authorization document. Any claims thereafter will be viewed as invalid.

Use Insured Courier or Registered Mail

Please make any returns via registered mail or insured courier, and be sure to keep the receipt. DIOANE cannot be held responsible for any jewelry damaged or lost in transit. Replacements cannot be made if we do not receive the jewelry in good condition. 

3. Shipping Policy

Delivery costs for Peninsular Malaysia, Sabah and also Sarawak will be charged according to the price stipulated by the logistics provider. We aim to deliver your order to you at the delivery address listed and by the delivery time indicated by us at the time of your order checkout. These details will also be listed in the order confirmation. Should any unforeseen circumstances affect your delivery, we will notify you of this to the extent permitted by law, however, we shall not be liable for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery. 

In case of any faults, issues, defects or damages, please feel free to reach out to our customer care representative. Please provide information about such issues during the call, including your order number, product details, etc, if needed. 

4. Payment Policy

For all orders made from us, you can pay via manual payments, internet banking or with a valid credit or debit card. Prices and shipping rates may be subject to change without prior notice however these changes will not be reflected for CONFIRMED (Paid) orders, For any issues regarding your payments, please feel free to reach out to our customer care consultant.

6.Personal Data

For purposes of this document, the expression “personal data” shall bear the meaning as defined by the Personal Data Protection Act 2010 (“PDPA”), and includes “sensitive personal data” (as also defined by the PDPA).

Where applicable, and in relation to any personal data that may have been or may from time to time hereafter be provided by or on behalf of such provider of personal data and/or obtained independently by Dioane Design PLT (“Dioane”) from other lawful sources (if any) in connection with a commercial transaction: -

1.    the data provider covenants that the provider of such personal data has acknowledged, confirmed and consented to DIOANE, and

2.    the data provider hereby acknowledges, confirms and consents to DIOANE collecting, recording, holding, storing, using, dealing with and otherwise processing such personal data, for any of the following purposes:-

     i.       for DIOANE’s record-keeping in the ordinary course of its business;

    ii.       to administer and give effect to the commercial transaction and the management and/or enforcement thereof, and to contact and communicate with the data provider and/or the organization and/or such other persons or companies as represented by the data provider;

    iii.       to enable DIOANE to inform the data provider and/or the organisation and/or such other persons or companies represented by the data provider regarding DIOANE’s products, services, upcoming events, promotions, advertising, marketing and commercial materials (including emails, SMS or other means) and/or to be used in, to provide and/or to improve the services of DIOANE, analysing consumption patterns and choices, market surveys, processing invoices and payments (including card payments) and providing other services to enhance and support the relationship of the data provider and/or the organization and/or such other persons or companies represented by the data provider;

   iv.       to enable DIOANE’s compliance with its obligations under any law, rule, regulation, by-law, order, guideline, directive, policy and such other requirements in force and as amended from time to time relating to the commercial transaction and/or relating to the conduct of the business or activities of DIOANE.

The data provider, the organization and/or such other persons or companies represented by the data provider respectively referred to above further acknowledge that information given or the request made by the data provider and/or the organisation and/or such other persons or companies represented by the data provider leading to the provision of any personal data is sufficient, accurate, complete and not misleading, and that such personal data is provided voluntarily and is necessary for the purposes set out above.

Where personal data is requested, the data provider, the organization or such other persons or companies represented by the data provider has the option not to provide additional information requested other than the information which DIOANE has indicated as necessary to facilitate the commercial transaction. If data provider does not complete the required fields for itself or on behalf of the organization or such other persons or companies represented by the data provider as the case may be, DIOANE will not be able to offer the services and/or fulfill the request of data provider and/or the organization and/or such other persons or companies represented by the data provider.

In connection with the purposes above, DIOANE is hereby permitted to disclose such personal data to the relevant authorities, DIOANE’s successor in interest, sponsors, advertisers, solicitors, insurers, adjusters, other advisers, suppliers, contractors and/or service providers, and DIOANE’s parent company, related and associated companies, affiliates and partners, some of whom may be outside Malaysia, who may undertake administrative, management and operational functions for or on behalf of DIOANE in respect of or arising from the commercial transaction or to support sales, marketing, promotion and/or advertising efforts.

In the event of a sale of business, disposal, acquisition, merger or reorganisation involving DIOANE or the assets of DIOANE to another party, personal data may be required to be disclosed and/or transferred to the other party as part of the process of sale, disposal, acquisition, merger or reorganisation. The data provider acknowledges and covenants that the provider of such personal data has acknowledged, confirmed and consented to DIOANE that such disclosure and transfer may occur and hereby permit DIOANE to release the personal data to the other party and its advisers and representatives and that the other party has the provider’s consent to process such personal data.

The provider of such personal data may request in writing for access to and to request for correction of personal data in accordance with the PDPA. In the event of such request, or if the provider of such personal data has an inquiry or complaint in respect of DIOANE’s handling of such personal data, the provider can contact DIOANE vide email to “contact@dioaneart.com”

In the event of any inconsistency between the English version and the Bahasa Malaysia version of the PDP clauses, the English version shall prevail over the Bahasa Malaysia version.

Data Peribadi

Dalam dokumen ini, ungkapan “data peribadi” mempunyai maksud seperti yang ditakrif oleh Akta Perlindungan Data Peribadi 2010 (“PDPA”) dan meliputi “data peribadi sensitif” (seperti yang ditakrif oleh PDPA).

Di mana berkaitan, dan berhubung sebarang data peribadi yang telah atau mungkin dari masa ke semasa diberi oleh atau bagi pihak pemberi data peribadi dan/atau yang didapati secara bebas oleh Dioane Design PLT (“Dioane”) dari sumber-sumber lain yang sah (sekiranya ada) yang berkaitan dengan transaksi komersial ini:-

(1)    pemberi data berwaad bahawa pemberi data peribadi tersebut telah mengakui, mengesahkan dan bersetuju terhadap DIOANE, dan

(2)    pemberi data peribadi tersebut mengakui, mengesah dan bersetuju terhadap DIOANE, memungut, merekod, memegang, menggunakan, mengendalikan, berurusan dengan dan memproses dengan apa cara jua data peribadi tersebut, bagi sebarang tujuan yang berikut:-

(i)  rekod simpanan DIOANE dalam urusan biasa perniagaannya;

(ii)  untuk mengendalikan dan memberi kesan kepada transaksi komersial dan pengurusan dan/atau penguatkuasaannya, dan berhubung dan berkomunikasi dengan pemberi data dan/atau organisasi dan/atau orang lain atau DIOANE yang diwakili oleh pemberi data;

(iii) untuk membolehkan DIOANE memaklumkan pemberi data dan/atau organisasi dan/atau orang lain atau DIOANE yang diwakili oleh pemberi data tentang produk DIOANE, perkhidmatan, acara yang akan datang, promosi, iklan, pemasaran dan bahan-bahan komersial (termasuk e-mel, SMS atau cara-cara lain) dan/atau untuk digunakan, memberi dan/atau membaiki perkhidmatan DIOANE, analisis corak penggunaan dan pilihan, kajian pasaran, proses invois dan bayaran (termasuk bayaran dengan kad) dan memberi perkhidmatan lain untuk meningkatkan dan menyokong hubungan antara pemberi data dan/atau organisasi dan/atau orang lain atau DIOANE yang diwakili oleh pemberi data;

(iv) untuk membolehkan DIOANE mematuhi kewajipan di bawah sebarang undang-undang, rukun, peraturan, undang-undang kecil, perintah, garis petunjuk, surat arahan, polisi, dan lain-lain kehendak yang berkuatkuasa dari masa ke semasa termasuk pindaan dari masa ke semasa berkaitan dengan transaksi komersial dan/atau berkaitan dengan kelakuan perniagaan atau aktiviti-aktiviti DIOANE.

Pemberi data, organisasi dan/atau orang lain atau DIOANE yang diwakili oleh pemberi data yang dirujuk di atas mengakui bahawa maklumat yang diberi atau permintaan oleh pemberi data dan/atau organisasi dan/atau orang lain atau DIOANE yang diwakili oleh pemberi data yang membawa kepada pemberian sebarang data peribadi adalah mencukupi, tepat, lengkap dan tidak mengelirukan dan sebarang data peribadi yang diberi adalah secara sukarela dan adalah diperlukan untuk tujuan di atas.

Di mana data peribadi diminta, pemberi data, organisasi dan/atau orang lain atau DIOANE yang diwakili oleh pemberi data mempunyai pilihan untuk tidak memberi maklumat tambahan diminta selain daripada maklumat di mana DIOANE menunjukkan adalah perlu untuk memudahkan transaksi komersial. Jika pemberi data tidak melengkapkan bidang yang dihendaki untuk sendiri atau untuk pihak organisasi atau orang lain atau DIOANE yang diwakili oleh pemberi data mengikut mana yang berkenaan, DIOANE tidak dapat memberi servis dan/atau memenuhi permintaan pemberi data dan/atau organisasi dan/atau orang lain atau DIOANE yang diwakili oleh pemberi data.

Berhubung tujuan-tujuan yang dinyatakan di atas, DIOANE adalah dibenarkan untuk mendedahkan data peribadi tersebut kepada pihak-pihak berkuasa berkenaan, pengganti kepentingan DIOANE, penaja, pengiklan, peguamcara DIOANE, DIOANE insuran, penyelaras (adjusters), lain-lain penasihat, pembekal, kontraktor dan pemberi perkhidmatan, dan DIOANE induk, DIOANE-DIOANE yang berkaitan atau sekutu dan rakan kongsi, yang mana beberapa mungkin berada di luar negara yang mengendalikan kerja-kerja pentadbiran, pengurusan yang tertentu dan fungsi-fungsi operasi untuk atau bagi pihak DIOANE yang berkenaan dengan atau yang timbul dari transaksi komersial ini atau menyokong jualan, pemasaran, promosi dan/atau iklan.

Dalam keadaan jualan perniagaan, pelupusan, ambilalih, gabungan atau susunan semula melibatkan DIOANE atau aset DIOANE kepada pihak lain, data peribadi mungkin perlu untuk didedahkan dan/atau dipindah kepada orang lain sebagai sebahagian proses jualan, pelupusan, ambilalih, gabungan atau susunan semula. Pemberi data mengakui dan berwaad bahawa pemberi data peribadi mengakui, mengesahkan dan bersetuju kepada DIOANE bahawa pendedahan dan pindahan mungkin berlaku dan membenarkan DIOANE untuk mendedahkan data peribadi kepada pihak lain dan penasihat dan wakil dan pihak lain yang mempunyai persetujuan daripada pemberi untuk memproses data peribadi.

Pemberi data peribadi tersebut boleh meminta secara bertulis akses kepada dan untuk meminta pembetulan terhadap data peribadi menurut peruntukan-peruntukan PDPA. Untuk membuat permintaan tersebut, atau sekiranya permberi data peribadi tersebut mempunyai sebarang pertanyaan atau aduan berhubung cara pengendalian data peribadi tersebut oleh DIOANE, pemberi tersebut boleh menghubungi DIOANE secara emel bagi “contact@dioaneart.com”

Sekiranya terdapat sebarang ketidakseragaman di antara versi Bahasa Inggeris dan Bahasa Malaysia klausa PDP ini, maka versi Bahasa Inggeris akan mengatasi versi Bahasa Malaysia.
